3. PERSONAL DATA

Data processing / Legal base:

In the context of processing the sales contract, we process the data necessary to conclude, execute or terminate a contract. These include in particular:

  • First Name, Last Name,
  • Delivery address,
  • E-mail address,
  • Invoice data, (only if you inform us that you desire to issue an invoice)
  • Telephone number
  • IBAN / Bank Account Number (only in cases of product return).

The legal basis is Article 6 (1) (b) of the CIS, i.e. you provide this data on the basis of the contractual relationship between us. Please note that when submitting your order, you unreservedly accept the terms of your personal data processing.

Recipients / categories of recipients:
For the purpose of processing the sales contract, we will forward your details regarding your full name, delivery address and contact number to a transport company authorized by us, in order to deliver the goods as planned. The transport company will contact you to prepare your delivery and agree on the delivery details. The data shall be transferred to the authorized transport company solely for that purpose, and the transport company shall process the data only for the execution of that purpose.


In order to ensure and optimize the ordering process, we examine, based on the information you have already provided, such as the delivery address, the smooth handling of the order in order to (technically) optimize the ordering procedures so that we can we respond to customer inquiries regarding ordering processes.

Storage duration / storage duration criteria:
To the extent that you have not given us your information to receive the newsletter, we store the data collected for the performance of the contract for time period as foreseen by the law. After that storage period, the reference to the face is completely removed

4. LEGISLATIVE FRAMEWORK IN RELATION TO CONSUMER ORDER PRODUCTION

Your order is a contract between you and Lidl Cyprus and is governed by the relevant laws and regulations of the Republic of Cyprus. In the event of any dispute the responsible part to resolve this dispute shall be the responsible  local courts of the Republic of Cyprus. The contract is mainly governed by the following laws:

- On Contracts Law Cap 149, as amended by Laws N.22 (1) / 1995 and N99 (1) / 2013 as applicable.

- Consumer Rights Law 2013 (L.133 (1) / 2013, as amended by Law N.187 (1) / 2017 and as applicable, and passed for the purposes of harmonization with Directive 2011 / 83 / EC of the European Parliament and of the Council amending Council Directive 93/13 / EEC and Directive 1999/44 / EC of the European Parliament and of the Council and repealing Council Directive 85/577 / EEC and Directive 97/7 / EC of the European Parliament).

- On The Unfair Commercial Practices of Businesses to Consumers Law of 2007, (Law 103 (1) / 2007 as amended by the Laws 8 (1) / 2013 and 135 (1) / 2013 and each time applicable and voted for the purpose of harmonization with Directive 2005/29 / EC of the European Parliament and of the Council and amending Council Directive 84/450 / EEC, Directives 97/7 / EC, 98/27 / EC, 2002/65 / EC of the European Parliament and of the Council and of Regulation (EC) No 2006/2004 of the European Parliament and of the Council).

 

Note: Only a person who has the legal capacity to conclude agreements according to the Law on Contracts, Article 11, can conclude a contract. In case of an order by a non-capable to conclude a contract person, Lidl Cyprus reserves the right to cancel the order and / or return the order through the guardian or the supervisor of the non-capable person. An order may also be made by a legal person through a legal representative.

5. PRODUCTS AVAILABLE FOR ORDER AND THEIR CHARACTERISTICS

The products that are available for order and their characteristics are accessible for the consumers on the website www.lidl.com.cy

 

6. ORDER CREATION

The product order can be submitted either by filling-out the online web form that exists on the official Lidl Cyprus website ( www.lidl.com.cy ), or by calling free of charge at the Lidl Cyprus customer service department at 800 944 04.

Below are described the steps you need to follow for every order method.

6.1 ELECTRONIC ORDER VIA THE OFFICIAL LIDL CYPRUS WEBSITE (WWW.LIDL.COM.CY)

The following steps are required for the submission of the electronic order:

  1. To fill out all the required fields of the form for conclusion of the remote contract.
  2. To read and accept the terms and conditions by checking the corresponding checkbox.
  3. To click on the “Submission” button in order to submit the order form.

Right after the order submission, the following confirmation will appear on the screen:

 

 

At the same time, you will receive an automatic electronic copy of your order at the electronic address that you have given during the order submission including all the details that you have entered along with the product details.

Within one working day from the order submission, and after we have checked and confirmed the stock availability of the product, we will send you a new e-mail with the order number and the bank account number where you can deposit the value of the product (in case you have chosen the bank deposit as payment method).

(In case that there is no stock available you will be accordingly notified by e-mail at the electronic address that you have registered)

6.2 PHONE ORDER

To submit your order by phone, you just have to call the Customer Service Department free of charge at  800 944 04 (for calls within Cyprus) and declare your interest for the product. The service hours are: Monday - Friday: 8: 00-20: 00, Saturday: 8: 00-19: 00.

The customer service representative will instantly check the availability of the product and after confirming the existence of stock, you will be asked to give the necessary details for the order. Soon after the call, you will receive an e-mail (Template 2), with the details that you have given, the details of the product, the order number, the bank account number (in case you have chosen the bank deposit as payment method) and an electronic link that will direct you to the terms and conditions of the order.

For communication purposes, the customer should have an active e-mail address either active mobile phone number to receive written communication with LIDL Cyprus (e-email / SMS).

 

6.3 PAYMENT

You can select one of the following payment methods:

a) Bank Deposit
The payment can be made by depositing the amount in the bank account that we will give you by e-mail/ SMS after we have confirmed the existence of stock.

Important! At the deposit, you should state the order number and your full name, so that we can associate your order with your payment.

Notes

  1. Your order will be in pending until we receive the confirmation of your deposit. Usually, the required time for the confirmation is 2 working days from the day of the deposit.
  2. In any case, we recommend you to keep the receipt of your deposit until the delivery of your order is completed.
  3. If the amount is not deposited within 5 working days, your order will be canceled.
  4. By depositing the amount, it is implied that you have unconditionally accepted all the terms and conditions that have been disclosed to you, through the electronic link on the official website of Lidl Cyprus (www.lidl.com.cy).

b) Cash on delivery

Important! In the event that you ordered and/or paid for the product before the official start date of the sale which is stated in our weekly brochure and on the product website, the delivery will begin on the first business day following the official start date of the sale.

For example, if the product you are interested in, has an official launch date on Saturday 04.05.19 and you made the order and deposited the amount before that date, then the 3-5 business day delivery time referred below is calculated from Monday 06.05.19.

 

7. PRODUCT DELIVERY

The delivery costs are free of charge.

As soon as we have confirmed the deposit of the amount, the preparation of your order begins. The deliveries of the products are made only within the areas controlled by the Republic of Cyprus and only by the cooperating transport company. The delivery schedule is from Monday to Friday, from 08:00 to 17:00.

The delivery takes from 3 to 5 working days, because it depends on the postal code of the dispatch area and is calculated from the time of confirmation of the deposit. (Exceptions are the orders that are made and/or paid before the official start date of the sale which is stated in our weekly brochure and on the product's website, and in that case the delivery will begin on the first business day following the official start date of the sale.)

When receiving your order, and before you sign the shipping document, please make sure that your package is delivered without external obvious signs of violation or damage. Otherwise, please record the remarks on the shipping card, sign and give the document to the driver.

8. CANCELLATION OF ORDER - RETURNS

You can of course cancel your order at any time.

In order to cancel your order, you just have to call the customer service department free of charge at 800 944 04 (For calls within Cyprus.) Service hours: Monday - Friday: 8:00 - 20:00, Saturday: 8: 00-19: 00) or send an email to info@lidl.com.cy stating your request. You should have your order number available.

In the event that you have already deposited the amount, the refund will be made via a deposit to your bank account as soon as possible and in any case within 14 days counting from the day that Lidl Cyprus has been informed of your decision to cancel the order. In this case, you will need to have your bank account number (IBAN) available for your cancellation request so that Lidl Cyprus can refund you.

 

8.2 RIGHT OF WITHDRAWAL

If you change your mind about your purchase, you have the right to withdraw from the contract without any justification or cost (right of withdrawal) by returning the product you purchased within 90 days. These 90 days begin to count when you, or a third party you designate, receive the product of your order.

Your right to return the product within 90 days of receipt of the product consists of the statutory 14 day withdrawal period and Lidl Cyprus' voluntary grant for an additional 76 days.

In order to exercise your right to withdraw, you can use the withdrawal form here and send it to us at info@lidl.com.cy or by mail to Lidl Cyprus, Pigasou 2, Aradippou Industrial Area, 6042 Larnaca .

Otherwise, you can send us an e-mail where you will explicitly state your request for a withdrawal, including your name, your order number, your address, and IBAN of your bank account where we will refund your money unless you have explicitly agreed to a different way of refunding the money, provided that you are not burdened with any cost arising from the refund.

Once we have received your request for withdrawal, we will contact the transport company to pick up the product from your premises after they have contacted you to agree on the desired date and time of receipt.

The shipping cost for the return your order is free of charge.

Products must in any case be returned to Lidl Cyprus, along with proof of purchase, within 14 days of the day you notify us of your decision to withdraw.

Note that the product you wish to return should be in perfect condition and accompanied by all the parts and components that the product consists of. A prerequisite for exercising the right of withdrawal is that the product has been properly used only to test its properties and functions. The returned product should be in its original condition and without any damage. The return should be made with the original packaging which must be kept in good condition. For this reason, we recommend that you store the product after receipt.

If we find that parts or accessories are missing upon receipt of the returned product or that the product's condition is different from its original condition, then we reserve the right not to accept your request for withdrawal.

Returns to the stores of our network will not be accepted. Please follow the return procedure as described above through the customer service department.

 

8.3 DEFECTIVE PRODUCTS

For all the products of course applies the legal guarantee.

If you notice that the product that you have purchased has a defect please contact the customer service department and one of our representatives will guide you through the steps you need to follow.

8.4 REFUNDS

Your refund will be reimbursed within a reasonable time, in any case within 14 working days, and after we have received and checked the returned product.

It is very important to carefully check the bank account number (IBAN) you will enter in the withdrawal form or in the message you will send by declaring us your wish to withdraw.

 

9. NON-IMPLIED EXECUTION DUE TO FORCE MAJEURE

In the event that, due to force majeure such as strikes, natural disasters, unpredictable weather conditions, riots, war and, generally, for reasons beyond our control, we will not be able to deliver the ordered goods in time according to your order, you will be informed by e-mail with the ultimate goal of expressing your will of whether you  maintain your desire to implement your order. We at Lidl Cyprus inform you that we will do our best to provide you with the best service in the circumstances, but note that we will have no responsibility for anything that is beyond our control and / or anything that we will not be accountable/ responsible for.

 

10. INCOMPLETE ORDER DELIVERY

Lidl Cyprus has the right to change and / or modify the terms of processing its transactions in this form. For any change and / or modification of these terms, Lidl Cyprus will promptly inform accordingly.
